SPANISH LAW ON INFORMATION SOCIETY SERVICES AND ELECTRONIC COMMERCE (LSSI)

INTERNATIONAL STUDIES S.A (hereinafter, CIS University)., the owner of the website, makes this document available to users in order to comply with the obligations set forth in Spanish Law 34/2002 of July 11th 2002 on Information Society Services and Electronic Commerce (LSSICE), as well as to inform all users of the website of its conditions of use.

Anyone who accesses this website shall be considered a user, undertaking to strictly observe and comply with the provisions set out herein, as well as any legal regulations that may be applicable.

CIS University reserves the right to modify, at any time, the presentation, configuration and location of its website, as well as the contents and conditions of use of these.

COMPANY REGISTRATION

PURPOSE

Through the website, we offer users the possibility of accessing information on our academic programs and other university services.

PRIVACY AND DATA PROCESSING

CIS University is aware of security and the need to guarantee the confidentiality of the data provided by our customers/users. To this end, regarding data protection, CIS University applies Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th 2016 (General Data Protection Regulation).

CIS University will only hold the personal data of such users as voluntarily wish to provide them through the website, using the mechanisms established for that purpose.

When, so as to access certain content or services, it is necessary to provide personal data, users guarantee the truthfulness, accuracy, authenticity and validity of such data. The university will subject such data to automated processing according to its nature or purpose, under the terms described in the section Privacy Policy.

INDUSTRIAL AND INTELLECTUAL PROPERTY

CIS University is the sole or assignee owner of all intellectual and industrial property rights of its web page, as well as of the elements contained therein (including but not limited to: images, sound, audio, video, software, texts, trademarks, logos, color combinations, structure, design, selection of materials used, etc.).

Pursuant to the provisions contained in articles 8 and 32.1 of Spanish Royal Legislative Decree 1/1996 dated April 12th, 1996, which approves the revised text of the Intellectual Property Law, regularizing, clarifying and harmonizing the current legal provisions on the subject, reproduction, distribution and public communication, including the option of making available, of all or part of the contents of this website, for commercial purposes, in any medium and by any technical means, without the express authorization of CIS University, is expressly prohibited.

The user agrees to comply with the Intellectual and Industrial Property rights held by CIS University. The user can view the portal elements, and even print, copy and store them on a hard drive or any other medium, provided that it is solely and exclusively for their personal, private use.

The user shall refrain from deleting, altering, evading, or manipulating any protective devices or security systems installed on CIS University’s webspace.

OBLIGATIONS AND RESPONSIBILITIES OF WEB SITE USERS

The user undertakes to:

  1. Make suitable and lawful use of the webspace, as well as the contents and services, in accordance with: (i) applicable legislation at all times; (ii) the webspace’s General Conditions of Use; (iii) generally accepted moral standards and good practice, and (iv) public order.
  2. Provide all the technical requirements and means required to access the webspace.
  3. Provide truthful information when completing the forms contained on the webspace with the user’s personal data and to keep such data updated at all times so that they match the user’s true situation. Users are solely responsible for the false or inaccurate statements they make and the damages they may cause the University or third parties due to the information they provide.

Notwithstanding the contents of the above paragraph, users shall also refrain from the following:

  1. Make unauthorized or fraudulent use of the webspace and/or contents for illicit purposes or effects, prohibited under these General Conditions of Use, use which is harmful to the rights and interests of third parties, or that in any way may damage, render useless, overload, deteriorate or impede the normal use of the services or the documents, files and any type of content stored on any medium.
  2. Access or try to access resources or restricted areas of the webspace without complying with the conditions governing such access.
  3.  Cause damage to the systems of the webspace, its suppliers or third parties.
  4. Enter or spread computer viruses or any other physical or logical systems that may cause damage to the physical or logical systems of the company, suppliers or third parties.
  5. Try to access, use and/or manipulate data owned by the University, third party providers and other users.
  6. Reproduce, copy, distribute or provide access to the general public through any type of public communication, transform or modify the content, unless authorized expressly by the owner of such rights or permitted by law.
  7. Delete, hide or manipulate notices describing intellectual or industrial property rights and other data identifying the rights of the company or third parties included in the contents, as well as technical protective devices or any information mechanisms that may be inserted in the content.
  8. In particular, including y not limited to the following, the user undertakes not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any type of material that:
  • In any form, is contrary to, undermines or infringes upon the fundamental rights and public freedoms recognized in the Spanish Constitution, in international treaties and in other legislation in force.
  • Induces, incites or promotes criminal, denigrating, defamatory or violent actions, or, in general, actions against the law, generally accepted moral standards, good practice or public order.
  • Induces, incites or promotes actions, attitudes or thoughts that are discriminatory on the basis of sex, race, religion, beliefs, age or condition.
  • Incorporates, makes available or allows access to products, elements, messages and/or services that are criminal, violent, offensive, harmful, degrading or, in general, against the law, generally accepted moral standards, good practice or public order. Induces or may induce an unacceptable state of anxiety or fear.
  • Induces or incites others to engage in practices that are dangerous, risky or harmful to health and psychological equilibrium.
  • Is protected by the legislation on intellectual and industrial protection belonging to the University, or third parties unless it has been specifically authorized for the use to which it is intended to be put.
  • Is contrary to honor, personal and family privacy or people’s own self-image.
  • Constitutes any form of advertising.
  • Includes any type of virus or program that hinders the normal functioning of the webspace.

If the user is provided with a password to access any of the services and/or contents of the Web Site, the user agrees to use it diligently and to keep it secret at all times. Consequently, the user shall be responsible for keeping such a password safe and confidential, undertaking not to transfer it to third parties, temporarily or permanently, or allow outsiders access to the aforementioned services and/or contents. Likewise, the user is obligated to notify the University of any event that may cause improper use of their password, such as, but not limited to, its theft, loss or unauthorized access, so as to ensure it is immediately cancelled. Consequently, until notification is given as stated above, the University shall be exempt from any liability that may arise from the improper use of the user’s password, and shall not be responsible for any illegal use of the contents and/or services of the webspace by any unauthorized third party. If the user negligently or willfully fails to comply with any of the obligations set forth in these General Conditions of Use, they will be liable for all damages that may arise from such breach for INTERNATIONAL STUDIES S.A. (CIS).

LIABILITIES

INTERNATIONAL STUDIES S.A. (CIS) declines all responsibility in the event that access to its web site is made impossible or hindered as a result of actions or omissions by third parties (power supply, telephone or other telecommunications providers, for example), unrelated to the University. Nor shall it be liable in cases of force majeure, actions of third parties in general, including administrative or judicial orders, sabotage or saturation, whether intentional or not.

INTERNATIONAL STUDIES S.A. declines all responsibility deriving from damages that the user may experience in their computer and telematic means as a result of the circumstances described in the above paragraph.

INTERNATIONAL STUDIES S.A. does not guarantee the availability and continuity of the website, nor is it liable for damages, or damages that may occur in the future, or technical defects of any kind arising from the use of the information and content therein.

INTERNATIONAL STUDIES S.A., within the limits established by current legislation, assumes no responsibility arising from any lack of updating and accuracy of the data contained on its website.

INTERNATIONAL STUDIES S.A. declines any liability for damages of any kind that may arise from the misuse of the services that are freely available to be used by users of the webspace. Likewise, it is exonerated from any responsibility for the content and information that may be received as a result of the data collection forms, the latter existing solely for the provision of the services contained in each of them at all times.

INTERNATIONAL STUDIES S.A. reserves the right to delete all comments and contributions that violate the dignity of others, are discriminatory, xenophobic, racist or pornographic, violate the rights of youth or children, public order or public safety, or which, in its opinion, are not appropriate for publication. In any case, INTERNATIONAL STUDIES S.A. will not be held responsible for the opinions submitted by users in any participation tool on the website.

HYPERLINKS

The User undertakes not to reproduce the website in any way, not even by means of a hyperlink, or any of its contents, unless expressly authorized in writing by the File Manager.

At www.cis-spain.com, links and hyperlinks may exist to other Internet websites which are not managed by INTERNATIONAL STUDIES S.A. and therefore over which it has no control. These links provide other information sources, and their inclusion in this web site does not imply any recommendation, invitation or suggestion to visit the destination pages and, therefore, INTERNATIONAL STUDIES S.A. will not assume any responsibility for the content that may arise from accessing the pages of third parties from its web site, nor guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, truthfulness, validity or constitutionality of any material or information contained in such hyperlinks or Internet sites. Furthermore, including these external links does not imply any kind of association, merger, or involvement with the linked entities.

RIGHT OF EXCLUSION

INTERNATIONAL STUDIES S.A. reserves the right to refuse or cancel the access to its portal and/or the services offered without prior notice, on its own initiative or at the request of a third party, of any users who do not comply with the Conditions of Use.

APPLICABLE LEGISLATION AND JURISDICTION

The relationship between INTERNATIONAL STUDIES S.A. and the user will be governed by the legislation in force at any time. Any disputes will be subject to the courts of the city of Madrid.
